Privacy Policy

Introduction

APP Claims (“we”, “our”, or “us”) is a service that refers potential clients to our panel of specialist law firms, all regulated by the Solicitors Regulation Authority (SRA). This Privacy Policy explains how we collect, use, and safeguard your personal information when you use our website or engage with our referral service.

We act as a data controller for the purposes of the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Information We Collect

We may collect and process the following information:

Information you provide to us:

  • Personal details (name, address, date of birth, email address, telephone number)
  • Basic information about your potential fraud claim to assess suitability for referral
  • Details about the fraud you experienced
  • Any other information you choose to share with us during the initial consultation

Information we collect automatically:

  • Technical information, including your IP address, browser type and version, time zone setting, operating system and platform
  • Information about your visit, including the pages you viewed, how long you spent on those pages, and how you navigated to our site

How We Use Your Information

We use your information for the following purposes:

  • To assess whether your case is suitable for referral to one of our partner law firms
  • To facilitate the referral of your case to the most appropriate law firm from our panel
  • To communicate with you about the referral process
  • To comply with our legal and regulatory obligations
  • To improve our website and services
  • To detect and prevent fraud

The legal basis for processing your information includes:

  • Performance of our contract with you
  • Compliance with legal obligations
  • Your consent, where specifically requested
  • Our legitimate interests in providing effective referral services and running our business

Data Storage and Security

We take appropriate technical and organizational measures to secure your information and protect it against unauthorized or unlawful processing and against accidental loss, destruction, or damage.

We retain your personal information only for as long as necessary for the purposes for which it was collected, including to satisfy any legal, accounting, or reporting requirements. For successful referrals, basic contact information and referral details may be retained for up to 6 years for regulatory compliance purposes.

Sharing Your Information

We will share your personal information with:

  • One or more of our partner law firms that are regulated by the SRA (when you proceed with a referral)

We may also share limited information with:

  • Our professional advisers, including lawyers and accountants
  • Regulatory authorities, when required by law
  • Service providers who help us deliver our services (all of whom are required to keep your information secure and confidential)

We will not sell, distribute, or lease your personal information to third parties unless we have your permission or are required by law to do so.

Law Firm Referrals and FOS Fees

When you are referred to one of our partner law firms, they will conduct their own assessment of your case. If they take on your case and it requires submission to the Financial Ombudsman Service (FOS), they will cover the £250 FOS fee for claims submitted through legal representatives. This ensures you don’t face additional financial burdens while seeking compensation for fraud.

Once your case is referred to a law firm, they will become the data controller for any additional information they collect, and their own privacy policy will apply to their handling of your data.

Your Rights

Under data protection law, you have rights including:

  • The right to access your personal data
  • The right to correction of inaccurate data
  • The right to erasure (in certain circumstances)
  • The right to restrict processing
  • The right to data portability
  • The right to object to processing based on legitimate interests

To exercise any of these rights, please contact us using the details below. There is generally no fee for exercising these rights, but we may charge a reasonable fee or refuse to comply if your request is clearly unfounded, repetitive, or excessive.

Cookies

Our website uses cookies to distinguish you from other users. This helps us provide you with a good experience and allows us to improve our site. For detailed information on the cookies we use and the purposes for which we use them, please see our Cookie Policy.
